The General Terms and Conditions govern the terms and conditions relating to the correct use of the website, the operation of each auction, the corresponding participation and the Contract that is concluded between Leasys Automarket and the User at the time of correct registration on the website.
The Contract with the User is formalised through registration on the website. By registering, the User accepts these General Terms and Conditions. The contract with the User is non-transferable.
The User provides Leasys Automarket with their personal data and independently chooses a password to access the Site.
The Site Administration will send the User an email to confirm registration. Following such confirmation, the User will be considered validly registered and may freely access their account by entering the previously established username and password.
The User undertakes to behave appropriately and not to cause damage to the website or other users, being responsible for all acts carried out on the website.
The User guarantees the truthfulness and completeness of the personal data provided during registration. In the event of any change to such data, the User must notify the Site Administration.
Leasys Automarket reserves the right to unilaterally refuse and/or cancel registration when:
Leasys Automarket will incorporate personal data into a file created for this purpose. By registering on the website, the User expressly accepts the privacy policy and authorises the use and retention of the registered personal data. At the User's request, Leasys Automarket will delete the data to the extent that doing so does not prevent compliance with legal, accounting or supervisory obligations.
Any total or partial reproduction of the website is prohibited without prior written authorisation from Leasys Automarket.
Use of the website's services is reserved for users who are of legal age and have full legal capacity. In the case of legal entities, use is permitted only to subjects with full authorisation and power of representation.
In order to participate validly in Auctions, it is necessary to be registered on the Site. Access credentials are personal and confidential, and the User will be responsible for any bids submitted, except in the case of immediate notification of loss or theft.
Auctions are conducted on an ascending basis, starting from the indicated minimum price, within the established time limit visible on the website via a timer.
During the Auction period, each submitted bid is irrevocable and binding and may not be withdrawn.
Once the Auction has ended and the reserve price has been exceeded, the highest bidding User will be the final Successful Bidder and may enter into commercial relations directly with the selling User. The sale and purchase will take place outside the website.
The selling User may carry out compliance checks in the area of anti-money laundering prevention (AML/CFT), which could result in the cancellation of the award, without any liability on the part of Leasys Automarket.
Leasys Automarket is exempt from any direct or indirect liability for the content published on the Site and for any service interruptions caused by factors beyond its control.
The selling User is solely responsible for the information, images and documentation of the published Vehicle. Leasys Automarket reserves the right to carry out appraisals and to suspend or remove content or access to the website at any time.
The User undertakes not to misrepresent their identity or infringe applicable regulations. They also undertake not to use the website for unlawful purposes or purposes that are detrimental to the rights of third parties or intellectual property.
Leasys Automarket does not guarantee the success of the auction or the conclusion of the sale. The Buyer accepts to acquire the Vehicle in the condition in which it is found ("seen and accepted").
The Buyer must pay the price as agreed with the selling User. In the event of non-compliance, the sale will not be concluded and the resulting costs will be borne by the Buyer.
Subsequent operations (delivery, collection, change of ownership, etc.) will be managed directly between the selling User and the Buyer. Leasys Automarket does not act as an intermediary and assumes no liability whatsoever.
Leasys Automarket shall not be liable for damages arising from improper use of the Site, breaches by the selling User, violations of third-party rights or force majeure events.
In the event of technical failures preventing access to the website, Leasys Automarket may extend the Auction. Leasys Automarket shall not be liable for damages arising from technical malfunctions or unlawful use by third parties.
These General Terms and Conditions apply together with applicable legislation in force. Partial invalidity shall not affect the remaining provisions. Leasys Automarket may amend the Conditions, which will enter into force 24 hours after their communication or publication.
Disputes shall fall under the exclusive jurisdiction of the Courts of Madrid, unless mandatory regulations provide otherwise. The Contract is governed by Spanish law.
The Buyer who has the status of consumer, in accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Defence of Consumers and Users, may exercise the right of withdrawal within fourteen (14) calendar days, counted from the day on which they take physical possession of the Vehicle, without the need to justify their decision and without any penalty, under the terms set out in Articles 102 et seq. of said legislation.
The exercise of the right of withdrawal must be communicated unequivocally to the Seller within the legally established period.
The consumer Buyer shall be responsible only for the diminished value of the Vehicle resulting from handling other than that necessary to establish the nature, characteristics and functioning of the Vehicle, in accordance with the provisions of Article 108 of Royal Legislative Decree 1/2007.

Data processing will be carried out in accordance with the GDPR (EU Regulation 2016/679) and applicable Italian regulations.
